- Preamble -

The general conditions of sale are concluded between :

The society Orange VTC Provence hereinafter referred to as "the Seller"

The seller reserves the right to modify or adapt at any time and without notice these general conditions of sale, in particular to bring them into compliance with the legal regulatory provisions.

The customer is therefore invited to consult them on a regular basis and before any service reservation. However, the general conditions applicable to each service will be those in force on the day of the final validation of the service by the customer. These general conditions of sale define the respective rights and obligations of the contracting parties on the occasion of the sale of the services provided by Orange VTC Provence.
By signing the agreement, the quote or the order form or by accepting the order confirmation, the customer formally acknowledges having read these general conditions of sale and having accepted them. Only derogations with a written agreement from the seller can modify the application of these general conditions.

- Cancelation -

Any cancellation of reservation less than 24 hours before the start of the service will be considered due and invoiced to the customer. Beyond a waiting period of 15 minutes at the pick-up location, the service will be considered due and invoiced to the customer.

In the event of the client's absence, the service will be considered due and invoiced.

- Reservation -

A request for a service must be the subject of a reservation confirmed in writing.
Reservations can be made on our site via the reservation modules present on the pages www.orange-vtc-provence.com, by phone at (+33) 6.72.09.57.18 or directly by email at orangevtcprovence@gmail.com. An email confirming our availability will then be sent by our services.

Any service reservation must be made no later than 24 hours before the start of the said service.
It must be made by the client or by a duly authorized agent.

Any reservation must imperatively mention the following elements: name and contact details of the customer (address, email, telephone), address of the pick-up location and address of the place of arrival for transfers, the desired duration for the availability, date and start time of the service, number of passengers and number of luggage.

A booking confirmation must be returned to us, by email or by post, marked “Good for agreement”, and signed by the customer. 

– Payment –

The services are payable in cash, in euros, on board the vehicle, when the customer is picked up.

We accept payment by bank transfer, in cash and by credit card (Visa, Mastercard, American Express, etc.). No discount is granted for payment on a date prior to the service. In all cases, the customer signing the reservation is solely responsible for payment of the service in the event of default by the user.

Any additional service, any excess of kilometer or duration, will be invoiced in accordance with the price indicated on the order form. Any hour started is due in full.

For wedding or excursion packages, the reservation only becomes firm after payment of a non-refundable deposit equal to 30% of the amount of the service.

– Limits of liability –

Orange VTC Provence can in no way be held responsible for delays in rail and air traffic.

Orange VTC Provence can in no way be held responsible for delays due to road traffic beyond its control: road blocked, bridge closed to traffic, traffic jams, flooded road, demonstration, weather conditions, interventions by the police, firefighters or customs, etc… (non-exhaustive list).

Orange VTC Provence can in no way be held responsible for delays directly resulting from an initial delay by the customer, or the need to make a trip, at the customer's request, within a time that is clearly too short.

In the event of immobilization of the vehicle due to a mechanical failure, an accident or damage (theft, degradation), Orange VTC Provence will endeavor to ensure the continuity of the route, either with one of these vehicles, or with a vehicle chartered from another company and undertakes to notify the principal.

– Restriction of access to the service –

Orange VTC Provence may restrict access to the Service to any Customer, without notice, in particular but not limited to, in the following cases :

– non-compliance by the customer with his obligations

– inappropriate behavior of the Customer or his companions on board the vehicles

– The absence of payment by the Customer of the sums due to Orange VTC Provence for races already completed or canceled after the arrival of the car.

– Insurance –

The responsibility of Orange VTC Provence remains limited to the terms of our insurance contract.

Our vehicles are insured for the transport of people and our travelers for all bodily injury with our insurer. This insurance also covers professional civil liability, in accordance with the French regulations in force, pursuant to article L. 3120-4 of the Transport Code.

– Litigation –

Any complaint must be notified in writing and by registered letter to the attention of Orange VTC Provence, within a maximum period of 8 days. After this period, no complaint will be successful.

Subject to legal provisions, any dispute is, by express agreement, the exclusive jurisdiction of the Commercial Court of Nîmes (Gard).
